These Terms & Conditions (“**Terms**”) govern your access to and use of the ModelsForge3D website, apps, and related services (collectively, the “**Service**”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

## 1) Eligibility
- You must be **at least 13 years old** to use the Service.
- If you are under 18 (or the age of majority where you live), you may use the Service only with the consent of a parent or legal guardian.
- You may not use the Service if doing so is prohibited by applicable laws.

- **Credits (Tokens)**: prepaid units used to access paid features (if available).
- **Job / Task**: a generation, upload, processing, or repair/check request submitted through the Service.
- **Input**: any content you submit (prompts, images, 3D files, text, settings, etc.).
- **Output**: any content produced by the Service in response to your Input (including generated 3D results, conversions, previews, and processed files).

## 3) Accounts & Security
Some features may require an account.
You agree to:
- Provide accurate, current information and keep it updated.
- Keep your login credentials secure and not share them with others.

You are responsible for activity that occurs under your account.

## 4) What the Service Does
ModelsForge3D provides tools that may include (depending on what is available at the time):
- **AI-powered 3D generation** (e.g., text-to-3D, image-to-3D, multi-image-to-3D);
- **Upload and conversion** of 3D files for viewing/processing;
- **Model processing tools** (e.g., remeshing/geometry optimization);
- **Repair/check tools** to help identify issues that can affect 3D printing.
The Service is continuously evolving. We may add, change, or remove features at any time.

## 5) Third-Party Providers (AI Generation)
We use third-party AI providers to perform some generation tasks, including **Meshy** and **Tripo** (“**Third-Party Providers**”).
By using AI generation features, you understand and agree that:
- Your Inputs (e.g., prompts, images) may be processed by Third-Party Providers to produce Outputs.
- Third-Party Providers may have their own terms/policies that apply to their services.
- We are not responsible for Third-Party Providers’ services, availability, or actions.

## 6) Inputs and Outputs (Your Content)
### 6.1 Your Inputs
You represent and warrant that:
- You have all rights needed to submit your Input; and
- Your Input does not violate laws or third-party rights (copyright, trademark, privacy, etc.).
### 6.2 Outputs
You understand that:
- Outputs may be inaccurate, incomplete, offensive, or not unique.
- Similar or identical outputs may be produced for other users.
- You are responsible for reviewing and validating Outputs before use, sharing, or relying on them.
### 6.3 License to Operate the Service
You keep ownership of your Input. However, you grant us a limited license to **host, store, process, reproduce, and transmit** your Input and Output **only as necessary to provide and operate the Service**, including to perform conversions, run processing/repair tools, deliver results, prevent abuse, and maintain security.

## 7) Acceptable Use (What You Must Not Do)
You agree **not** to use the Service to:
### 7.1 Illegal, harmful, or abusive content
- Violate any law or regulation.
- Create, upload, or distribute content involving:
- sexual content involving minors,
- terrorism or violent extremism,
- self-harm encouragement,
- explicit hate or harassment targeting protected groups,
- threats or incitement of violence,
- illegal goods or illegal activity.
### 7.2 Infringe rights or misuse personal data
- Upload or generate content that infringes copyright, trademarks, trade secrets, or other rights.
- Use personal data of others without permission (including private/confidential information).
- Impersonate others or misrepresent affiliation.
### 7.3 Abuse the platform
- Reverse engineer, decompile, or attempt to extract source code, models, or algorithms (except where permitted by law).
- Use bots/scrapers or automated means to access the Service in a way that disrupts or overloads it.
- Circumvent security, rate limits, or access controls.
- Introduce malware, viruses, or harmful code.
- Use the Service to develop or offer a product that competes with the Service by copying its features or systematically extracting outputs at scale.
We may remove content, limit features, suspend, or terminate accounts that violate these rules.

## 8) 3D Printing & Safety Disclaimer
Models and files produced by the Service may be **non-manifold, fragile, incorrectly scaled, or otherwise unsuitable** for printing or real-world use.
You are solely responsible for:
- verifying geometry, dimensions, tolerances, and print settings;
- ensuring safe materials and safe operation of your equipment;
- complying with laws and safety standards.
Do not use Outputs for applications where failure could cause harm (e.g., safety-critical parts) without professional review and testing.

## 9) Payments, Credits, and Subscriptions (If Applicable)
Some parts of the Service may require payment (Credits/Tokens/subscriptions).
- Payments are processed by **third-party payment processors**. We do not store full payment card details.
- Prices, packages, and usage rules are described at the point of purchase and may change over time.
- If subscriptions are offered, they may **auto-renew** unless canceled before the renewal date.
Refunds, if any, are governed by our **Refund Policy** and any non-waivable rights under applicable law.

## 10) Storage and Deletion
We may store Inputs/Outputs for as long as needed to operate the Service, provide downloads, prevent abuse, and comply with legal obligations. Storage periods may vary by feature and may change over time.
You are responsible for keeping your own backups of any Input/Output you want to retain.

## 11) Copyright Complaints (Notice & Takedown)
If you believe content on the Service infringes your copyright, you may send a notice to:

Include:
1) Your name and contact info (email required),
2) Identification of the copyrighted work,
3) The URL or clear description of where the allegedly infringing material is located,

5) A statement, under penalty of perjury, that the notice is accurate and you are authorized to act,
6) Your physical or electronic signature.
We may remove or restrict access to the material and may terminate repeat infringers where appropriate.

We may suspend or terminate your access to the Service at any time if:
- you violate these Terms,
- we must do so to comply with law, or
- your use creates risk or harm to the Service, other users, or third parties.

- the Service will be uninterrupted or error-free,
- outputs will be accurate, printable, or unique,
- third-party services will be available.

- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE **3 MONTHS** BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top. By continuing to use the Service after changes become effective, you agree to the updated Terms.

## 17) Governing Law & Disputes
These Terms are governed by the laws of the **State of Delaware, USA**, excluding conflict-of-law rules, **except** where your local consumer protection laws require otherwise.
